Democrats ‘will pack the Supreme Court’ if they win the Senate and White House, Cruz says

Sen. Ted Cruz, a member of the Senate Judiciary Committee, said Wednesday that he thinks Democrats "will pack the Supreme Court" if they hold onto the House and win the Senate majority as well as the White House.

"Today's Democrats are completely radicalized. If Joe Biden and Kamala Harris win in November, they will pack the Supreme Court. And Chuck Schumer will end the filibuster to help them do it," Cruz told Just the News in a statement.

"That's why they don't want to answer any questions about it to the point where it's gotten bizarre. But make no mistake: if the Democrats get power, they will pack the court, politicize it, and destroy its independence," he added.

Biden, the Democratic presidential nominee, declined to say if he would seek to expand the Supreme Court and nominate justices to fill the added seats, during the first presidential debate against President Trump, on Sept. 29.

He later evaded several subsequent questions on the topic. Sen. Kamala Harris, Biden's running-mate, avoided answering the court packing question during the debate against Vice President Mike Pence.

On Tuesday, Biden told a local news outlet in Ohio that he's "not a fan of court packing."

On Wednesday, during the third day of Judge Amy Coney Barrett's Supreme Court confirmation hearings, Cruz said packing the court means "expanding the number of justices to achieve a political outcome."

"Packing the court is wrong. It is an abuse of power," he said. "I believe, should they win in November, that our Democratic colleagues will pack the court. I think that's why Joe Biden refuses to answer it, although, he did say, when asked, the voters don't deserve to know his answer as to whether he'll pack the court."

Cruz also slammed Democratic lawmakers such as Delaware Sen. Chris Coons for making the “new argument" that Republicans have been court packing.

"What utter nonsense," Cruz said. "Filling judicial vacancies is not what that term means and they are endeavoring to redefine the language to set the framework, to set the predicate for a partisan assault on the court."
