Former Trump lawyer says strong evidence to support motion to dismiss classified documents case

Former Trump attorney Timothy Parlatore said Thursday that the former president's Florida classified documents case could face a fatal blow. 

"I think so," Parlatore answered when asked if the case could be doomed after being postponed. " I mean, that's a case that from the beginning has been hopelessly infected by prosecutorial misconduct."

On Wednesday, a federal judge postponed former President Donald Trump's classified documents case in Florida indefinitely, citing issues with classified evidence.

Trump's lawyers are accusing special counsel Jack Smith of hindering a review of video evidence in the case.

Parlatore predicted that the case could be resolved through a motion to dismiss for misconduct, possibly before the election.

"A lot of that stuff is already in the record," he said. "Will it be fully litigated and decided possibly before the election? It could be. A lot of that just depends on what type of schedule the president's lawyers choose to pursue."
