Hunter Biden seeks sentencing delay in federal gun case
Biden is currently scheduled to be sentenced on Nov. 13, but has requested the sentencing be delayed until later in the month or early December.
Lawyers for first son Hunter Biden on Tuesday requested a sentencing delay in his federal gun case, over concerns that his sentencing would overlap with a civil case that takes place across the country.
Biden was convicted on three federal gun charges by a Delaware jury in June, in connection with the purchase of a gun in 2018. He is currently scheduled to be sentenced on Nov. 13, but has requested the sentencing be delayed until later in the month or early December.
The first son's lawyer Abbe Lowell told the judge overseeing the gun case that Lowell is expected to appear in court for a civil case in California on the day before the sentencing.
“Such a postponement will accommodate both counsel and those working with counsel to prepare the necessary pre-sentencing materials and memoranda, and to allow lead counsel to participate at the hearing,” Lowell wrote in his request.
Lowell also claimed that some of the witnesses who would testify in the sentencings are currently on the campaign trail or in the Biden administration and would not able to testify until some time after the November election, according to The Hill.
If the delay is approved, the new sentencing cannot fall on Dec. 16, when Biden is expected to be sentenced for a different criminal case in California. Biden pleaded guilty to nine tax charges earlier this month.
