Commonwealth Attorney's Office, led by prosecutor Biberaj, who faces recall, removed from case

A judge in Virginia's Loudon County has removed the county's Commonwealth’s Attorney's Office from a case, saying that it lacks "the ability to apply basic legal principals."

The office is led by Buta Biberaj, who is facing a recall effort for "failing to enforce the law."

A former employee recently told Fox "Buta pushes to let people out generally."

"The Commonwealth is deliberately misleading the Court, and the public, in an effort to ‘sell’ the plea agreement for some reason that has yet to be explained," said Loudon County Circuit Court Judge James Plowman in the order.

The case involves Kevin Enrique Valle was arrested on two felony burglary charges and three misdemeanors for destruction of property and false identification.

The attorney's office said the crimes occurred within hours of one other, but the judge deemed that statement "entirely inaccurate” and described it as a “crime spree spanning four counties over ten days."

The case will now be prosecuted by the Fauquier Commonwealth’s Attorney’s Office.
