Trump seeks dismissal of Fani Willis case in Georgia
Willis charged Trump and a litany of co-defendants last year under the state's RICO Act in connection with his 2020 election challenge in the Peach State.
President-elect Donald Trump's legal team on Wednesday asked the Georgia state Court of Appeals to dismissal Fulton County District Attorney Fani Willis's election case against him, arguing the court has no jurisdiction in light of his election to the presidency.
Willis charged Trump and a litany of co-defendants last year under the state's RICO Act in connection with his 2020 election challenge in the Peach State. The case was marred by allegations that Willis maintained an inappropriate relationship with Nathan Wade, the special prosecutor whom she hired to pursue it.
Trump attorney Steve Sadow argued in a Wednesday filing that "A sitting president is completely immune from indictment or any criminal process, state or federal," CNN reported.
“President Trump respectfully submits that upon reaching that decision, this Court should dismiss his appeal for lack of jurisdiction with directions to the trial court to immediately dismiss the indictment against President Trump," he continued.
The court has yet to decide whether Willis may remain on the case at all. A judge previously determined that she could continue if Nathan Wade stepped down, but Trump appealed that decision, hoping to disqualify her as well.
