Federal judge agrees to cancel Comey court appearance in Trump threat case

The former FBI director made his first appearance in the case last week after surrendering to authorities in Virginia, but he is currently scheduled to appear in federal court in Greenville, North Carolina, on Monday.

A federal judge agreed Thursday to cancel former FBI Director James Comey's upcoming court appearance after he already appeared in court for the same case last week if he files an official waiver for it.

Comey was indicted by a grand jury in North Carolina last month for posting a photo of shells on a beach last year with the inscription "86-47" that prosecutors alleged was a threat against the president. Comey said he did not know what the inscription meant.

The former FBI director made his first appearance in the case last week after surrendering to authorities in Virginia, but he is currently scheduled to appear in federal court in Greenville, North Carolina, on Monday, according to the Associated Press.

U.S. District Judge Louise Flanagan, who was appointed by former President George W. Bush, said she would cancel the appearance in North Carolina if Comey files a waiver for the hearing by Friday, but the hearing will go on as planned if he does not.

Comey is expected to file the waiver after he signaled in a court filing that he would file one if the judge orders it, and indicated his request to drop the court appearance is supported by the Justice Department.

The former FBI director has not entered an official plea in the case so far but has maintained his innocence. He has been charged with making a threat against the president and transmitting a threat in interstate commerce.

Acting Attorney General Todd Blanche said Comey faces up to 20 years in prison if convicted of the two federal charges.
