Virginia asks Supreme Court to restore new voting map in redistricting fight

The Virginia Supreme Court struck down the state's redistricting referendum last week, ruling that the legislative process in which the referendum was created was unconstitutional.

Virginia's Democratic Attorney General Jay Jones on Monday asked the United States Supreme Court to overturn the state Supreme Court's decision to block its newly redrawn congressional map, which voters approved in a referendum last month.

The Virginia Supreme Court struck down the state's redistricting referendum last week, ruling that the legislative process in which the referendum was created was unconstitutional.

Virginia Democrats claimed in an emergency appeal that the decision to strike down the maps “deprived voters, candidates and the commonwealth of their right to the lawfully enacted congressional districts, according to the New York Times.

The officials claimed the ruling by the state’s Supreme Court had amounted to “judicial defiance” of the will of the voters to create a new district map, and asserted the state court was “deeply mistaken” on “critical issues of federal law with profound practical importance to the nation.”

The appeal comes after the maps were approved in the referendum last month that was decided by voters in a 51-49% split.

The Virginia Democrats also urged the high court to take up its appeal because it revolves around what they claim is a question of federal law — the definition of “Election Day," even though the state constitution is usually left to the state Supreme Court.
