New Jersey Dem Gov Sherrill signs immigration bills limiting scope of state cooperation with ICE

“To be crystal clear: we will not abide by this unconstitutional ban,” acting DHS Assistant Secretary Lauren Bis said. “The Supremacy Clause makes it clear that New Jersey’s sanctuary politicians do not control federal law enforcement.”

New Jersey Democratic Gov. Mikie Sherrill has signed into law three state immigration bills that will effectively limit the state's cooperation with federal immigration enforcement.

The state laws limit the cooperation between state and federal immigration officials, forbid local officials from sharing the immigration statuses of state residents with federal officials and ban federal agents from wearing face masks while carrying out immigration operations in New Jersey.

“Donald Trump’s untrained, unaccountable, masked ICE agents are putting people in danger,” Sherrill posted to X in signing the laws Wednesday. “That’s why I just signed a package of legislation to keep our communities safe – strengthening trust between law enforcement and the communities they serve ... In New Jersey, we still follow the Constitution and uphold the rule of law.”

The Department of Homeland Security says laws violate the U.S. Constitution's Supremacy Clause because they try to limit actions of federal officers.

“To be crystal clear: we will not abide by this unconstitutional ban,” acting DHS Assistant Secretary Lauren Bis told The Hill newspaper. “The Supremacy Clause makes it clear that New Jersey’s sanctuary politicians do not control federal law enforcement.”

The Trump administration has defended federal agents wearing face masks while on duty to protect their identities because of an increase in attacks on federal immigration officials.

California has already attempted to ban federal agents from wearing face masks but a federal judge ruled last month that the state law violated the Supremacy Clause.
