The threat of legal action comes just two days after the Adams administration signed an executive order authorizing the U.S. Immigration and Customs Enforcement, the FBI and the Drug Enforcement Administration to set up office space on the island, which houses city jails.

He entered office earlier this year, having won his congressional seat during the 2022 midterms.

The court hearing has been tentatively scheduled for Oct. 4, which would likely push the trial until after the 2024 presidential election on Nov. 5.
Smith had initially asked the Supreme Court to intervene ahead of the appeals court, which the justices declined to do.
The charges include one count of conspiracy each, 29 counts each of threats and false information regarding explosives, and four counts of transmitting threats in interstate and foreign commerce.
