Federal prosecutors say Thomas Caldwell plotted months in advance, working with self-styled militia groups including Proud Boys.
Federal prosecutors say Thomas Caldwell plotted months in advance, working with self-styled militia groups including Proud Boys.
"According to the charging documents, Watkins, Crowl, and Caldwell communicated with each another in advance of the Jan. 6, 2021, incursion on the U.S. Capitol and coordinated their attack," the DOJ noted.
In total, five members of the group faced seditious conspiracy charges.
Their convictions were initially part of a larger case that included group founder Stewart Rhodes, but their case was split off from that of their leader.
Seditious conspiracy has a maximum sentence of 20 years in prison, though Rhodes was also convicted of obstruction of an official proceeding and aiding and abetting.
The affidavit comes amid claims that a crowd stormed the building in response to comments from President Trump at a Jan. 6 rally.
"Veterans do not wish to overthrow the country," one former paratrooper said.
The claim arrives in the form of a footnote in a 41-page motion to dismiss charges against members of the Oath Keepers.
"None of the CHSes provided evidence of guilt on the part of the Oath Keepers as an organization, or the individual Defendants in this case."
