Left-leaning media outlet "The Daily Beast" published an op-ed Tuesday arguing that had Supreme Court Justice Ruth Bader Ginsburg retired during the second term of Democrat Barack Obama's presidency, the court would not be preparing to possibly overturn the precedent established its landmark Roe v. Wade abortion case.

"Ginsburg alone couldn’t have saved the court, but in giving up her seat she could have stalled its transformation into the conservative juggernaut that is about to achieve the Republicans' Holy Grail," writes Danielle Moodie, who further argues that succeeding President Donald Trump wound up seating three justices in a single term.

This is not the first time the possibility of Ginsburg's retirement during the Obama years has been retroactively commented upon.

"Just a reminder that Ruth Bader Ginsburg could have casually retired at 80 yrs old under Obama and been replaced by an ultra progressive in their 40s...but they chose not to. It's not Republicans' or Trump's fault that they get the opportunity to push through a new justice," reads a tweet that went in the immediate wake of Ginsburg's death in September 2020.

Many speculate that Ginsburg's plan was to retire during the presumed presidential term of Hillary Clinton, who lost to Trump in 2016. The original poster of the aforementioned tweet concluded his train of thought by writing, "NEVER bet on Hillary Clinton."

Moodie also writes: "When Ginsburg made her decision to stave off retirement it was up to Democrats to do what they could to protect the court from the unrelenting assault Republicans have been waging for decades. What would that have meant?

"Not rolling over and allowing Mitch McConnell to hold Merrick Garland’s seat hostage and certainly not allowing him to do so again by ignoring the request of Justice Ginsburg from her deathbed to not let Trump replace her."
