Former acting US AG says Trump and Biden must be treated the same in terms of classified docs

Former acting United States Attorney General Matt Whitaker says that President Biden and former President Donald Trump need to both be treated fairly when it comes to classified documents. 

"I think both the special counsels, Mr. Smith in the case of Donald Trump and Mr. Hur in the case of Joe Biden — I think are both going to need to coordinate what they determine the law is," Whitaker said on the Tuesday edition of the "Just the News, No Noise" TV show.

"I've talked a lot about this," he later stated. "These are the types of cases that we need to make sure the law is applied equally."

In the past few weeks, it was revealed that President Joe Biden had classified documents in multiple places such as his home in Delaware and at his former office at the Penn Biden Center in Washington. Former President Trump was found to have classified documents in his Mar-a-Lago home, resulting in an FBI raid. 

The GOP has criticized the FBI for not treating President Biden the same way regarding the documents found in his home.

"We've heard anecdotally the stories of people on missile submarines being charged for these types of crimes such as taking classified documents home," Whitaker stated. "At the same time, we have to have some prosecutorial discretion as it relates to transitioning from presidencies and from the White House."
