Fed appeals court to hear case on judge halting Trump deporting accused gang members to El Salvador

Earlier this month, U.S. District Judge James Boasberg issued an order temporarily blocking the Trump administration from using the Alien Enemies Act to deport illegal migrants to El Salvador and Honduras.

The D.C. Court of Appeals will hear arguments Monday on whether federal Judge James Boasberg had the authority earlier this month to temporarily halt the Trump administration's efforts to deport Venezuelan illegal migrants under a wartime law from 1798. 

On March 15, Boasberg, a U.S. District judge, issued an order temporarily blocking the Trump administration from using the Alien Enemies Act to deport illegal migrants to El Salvador and Honduras. 

Administration lawyers argued that the planes were already in the air. Boasberg ordered the planes to be turned around, but they didn't. 

The administration requested a stay pending appeal the day of the ruling, referring to it as a "massive, unauthorized imposition on the Executive’s authority to remove dangerous aliens who pose threats to the American people," according to Fox News.

In a March 17 hearing, Boasberg ordered the Trump administration to provide the court with information on the flights.

The administration was given a noon deadline on March 18 and ordered to be back in court, but it did not meet the deadline. 

Boasberg criticized the administration for missing the deadline, saying it "again evaded its obligations" to turn over information about the flights and individuals on them.
