Federal judge sets February 2027 trial date for DC pipe bomb suspect

The trial will take place February 16.

A federal judge on Wednesday scheduled a trial date of February 2027 for Brian J. Cole Jr., who has been charged with planting pipe bombs near the national headquarters of the Democratic and Republican parties on the eve of the Jan. 6, 2021 Capitol riot. 

U.S. District Judge Amir Ali said the trial will take place Feb. 16 and last about two weeks, according to the Associated Press, and Cole's defense attorney said they have not discussed the possibility of a plea deal with prosecutors to resolve the case.

The date comes after the judge ruled Monday that President Donald Trump’s blanket pardons for rioters explicitly applied only to people who were convicted of crimes related to the Jan. 6 attack and therefore Cole does not get the pardon. 

Cole was also not arrested or charged when the president issued the pardons, Ali pointed out in the earlier ruling, because he was arrested nearly a year later. He was indicted by a grand jury on four charges: Interstate transportation of explosives, malicious intent to use explosives, an act of terrorism while armed and attempting to use weapons of mass destruction.

On the first day of his second term in the White House, Trump pardoned, commuted the prison sentences and ordered the dismissal of cases for all 1,500-plus people charged in the Jan. 6 attack.
