Judge rejects Trump bid to toss conviction in Bragg case over SCOTUS immunity ruling
Judge Juan Merchan ruled on Monday that the Bragg case related “entirely to unofficial conduct entitled to no immunity protections."
A judge has rejected President-elect Donald Trump's bid to throw out his criminal case in New York over a recent Supreme Court ruling establishing the scope of presidential immunity.
Trump had sought to throw out Manhattan District Attorney Alvin Bragg's hush money case, and his conviction on 34 counts of falsifying business records, but the judge declined to do so.
Judge Juan Merchan ruled on Monday that the Bragg case related “entirely to unofficial conduct entitled to no immunity protections," according to CNN.
The Supreme Court ruled earlier this year that presidents enjoyed absolute immunity for constitutional acts and presumptive immunity for official ones. The ruling served to delay proceedings in special counsel Jack Smith's now-defunct D.C. election case.
