Lawyer for mistakenly deported Maryland man says he will be back to US in next few weeks
Garcia is a Maryland resident who got a legal status known as "withholding of removal" in 2019 after a judge determined he would be persecuted by gangs if he went to El Salvador.
The lawyer for Kilmar Armando Abrego Garcia, the Salvadoran national living in Maryland, who was mistakenly deported to his homeland, expects his client to be returned to the U.S. in a matter of weeks, based on court proceedings.
“I have every expectation that the Supreme Court will rule quickly and will rule in our favor, because when push comes to shove, this is not an exceptional case," attorney Simon Sandoval-Moshenberg said during a Tuesday interview with ABC News.
Garcia was arrested and detained by ICE agents last month, for alleged being an MS-13 gang member. He had legal status known as "withholding of removal" after a judge determined in 2019 that he would be persecuted by gangs if he went to El Salvador.
Garcia also had a history of failing to appear in court for traffic citations.
The Trump administration admitted it made a mistake when deporting him.
Over the weekend, U.S. District Judge Paula Xinis ordered that the Trump administration had to return him by midnight on April 7.
Supreme Court Chief Justice John Roberts halted the judge's decision earlier this week.
