A Chicago-based subcontractor, II in One, filed a $40 million lawsuit against a New York-based engineering firm working on the construction of the Obama Presidential Center.

The lawsuit alleged that racial discrimination required the form to do extra work and put it at risk of bankruptcy.

Robert McGee, the owner who filed the lawsuit in January, argued that the engineering firm, Thornton Tomasetti, imposed rules that contradict American Concrete Institute standards, according to Fox News.

He argued in the lawsuit that the changes resulted in "excessively rigorous and unnecessary inspection" and major overruns.

The Obama Presidential Center is a roughly $830 million project.
