The Supreme Court on Monday agreed to hear a request from ExxonMobil and Suncor to throw out a climate lawsuit the city of Boulder, Colo., brought against them.

The city sued the companies, alleging that they deliberately contributed to the climate crisis, though the oil companies have asked the court to assert that federal law bars state-level claims of climate injuries, The Hill reported.

The city argues that federal law does not bar a state from pursuing claims against out-of-state actors for in-state harm.

“The Court should grant review and clarify that state law cannot impose the costs of global climate change on a subset of the world’s energy producers chosen by a single municipality,” the oil companies stated.
