Special counsel Jack Smith appeals decision to dismiss Trump's classified documents case

The case could eventually reach the Supreme Court.

Special counsel Jack Smith on Wednesday requested that the 11th Circuit appeals court revive the classified documents case involving former President Donald Trump that was dismissed earlier this week. 

Smith was expected to appeal the decision. The case will be heard at the 11th Circuit Court of Appeals located in Atlanta, Georgia, according to CNBC News.

On Monday, Florida Judge Aileen Cannon dismissed Trump's classified documents case, arguing that "Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution."

A spokesperson for Smith's office told outlets that they don't have any comment at this time beyond filing the dismissal request. 

The case could eventually reach the Supreme Court.
