Trump co-defendant Chesebro in Georgia election case seeks dismissal, alleging paperwork error

Another Trump co-defendant, David Shafer, announced Friday that his legal team has filed a motion, joining the Chesebro motion to dismiss the indictment.

One of former President Donald Trump's co-defendants in the alleged election interference case in Georgia is seeking to have his case dismissed over a purported paperwork error by a prosecutor.

In a filing earlier this week, Kenneth Chesebro's attorney alleged that Fulton County special prosecutor Nathan Wade, who was brought in to help investigate the case, didn't file the oath of office that is required to join District Attorney Fani Willis' prosecution team, according to ABC News

"Nathan Wade, who has and continues to serve as lead counsel in this case – including during the presentment of the case to the criminal grand jury and at the time the underlying indictment was returned – was not an authorized public officer by Georgia law," the filing states, according to the outlet. 

Another Trump co-defendant, David Shafer, announced Friday that his legal team had filed a motion, joining the Chesebro motion to dismiss the indictment.

"The Trump special prosecutor in Georgia failed to file his oath of office with the court as required by law," Shafer wrote on the social media platform X,. "The irony here is that I am being prosecuted for impersonating a 'public officer' by someone who is apparently impersonating a public officer. We have filed a motion joining the Chesebro motion to dismiss the indictment."

Earlier this year, Trump and his 18 co-defendants surrendered on felony charges related to alleged efforts to overturn the 2020 election result in Georgia. 

Chesebro's trial is expected to start in three weeks.
