Government agencies will be sending production emails to federal employees this week, instead of the Office of Personnel Management (OPM), the Associated Press reported on Friday.

The change comes after a federal judge in California this week criticized OPM for trying to hire and fire employees outside of its own office, stating that only individual agencies and departments had the power to do so. OPM previously warned federal employees that if they do not respond to the email, it would be viewed as a resignation or they could be fired.

The first email was sent last week, and asked employees to list five things they accomplished during the week. But many departments told employees not to worry about complying. The next email is scheduled to go out on Saturday, sent by each agency individually, per AP.

It is not clear if the new structure will change how employees in the intelligence community respond to the emails because of the confidentiality of their work.

The Trump administration has defended the emails, with President Donald Trump stating that they were trying to get more transparency about the work the federal government is doing.

“What [Elon Musk] is doing is saying, ‘Are you actually working?’” Trump said last week. “And then, if you don’t answer, like, you’re sort of semi-fired or you’re fired, because a lot of people aren’t answering because they don’t even exist.”
