The Fifth Circuit Court of Appeals on Tuesday stayed lower court rulings regarding the release of three illegal migrants into the United States while the courts debate whether the men have a constitutional right to bond hearings.

The unsigned order centers on three men in Texas who were arrested by state troopers between November 2025 and February 2026 during routine traffic stops. 

The three men, identified as Ignacio Sosnava Rodriguez, Miguel Angel Gomez Alvarado and Alejandro Villegas Angel, have been released back into the country after multiple courts blocked the Trump administration from holding migrants for more than 90 days without giving them an opportunity to ask for release on bond while deportation proceedings are pending.  

The latest order clears the way for the three men to be taken back into immigration custody, according to Bloomberg.

"The full Fifth Circuit has issued an extraordinary precedential order making clear that illegal aliens do not have a constitutional right to roam free in the United States during their removal proceedings," Assistant Attorney General for the Justice Department's Civil Division Brett Shumate said on X.

The case has the potential to impact thousands of migrants who are being held in Immigration and Customs Enforcement facilities in states within the court's jurisdiction, including Texas and Louisiana.
