Multiple states sue the Biden administration to stop expanding ACA to cover illegal aliens
“Illegal aliens shouldn’t get a free pass into our country,” Kansas Attorney General Kris Kobach said in a statement.
Fifteen states have filed a lawsuit against the federal government challenging a rule that allows healthcare coverage from the Affordable Care Act to be given to illegal aliens.
Centers for Medicare & Medicaid Services is also being sued by the states. The current law allows health benefits from the Affordable Care Act to be given to those in the Deferred Action for Childhood Arrivals (DACA) program.
“Illegal aliens shouldn’t get a free pass into our country,” Kansas Attorney General Kris Kobach said in a statement. “They shouldn’t receive taxpayer benefits when they arrive, and the Biden–Harris administration shouldn’t get a free pass to violate federal law.”
The states involved in this lawsuit include Alabama, Indiana, Montana and Kansas.
The plaintiffs argue in the lawsuit, which was filed in the United States District Court for the District of North Dakota, that those in the DACA program do not qualify to get the health benefits.
"Plaintiffs are all sovereign states of the United States of America, suing to vindicate their sovereign, quasi-sovereign, and proprietary interests; the financial condition of themselves and their individual citizens; and their citizens’ health, safety, and welfare," the lawsuit reads.
