A federal appeals court on Saturday affirmed a judge’s ruling to dismiss a lawsuit by Rep. Louie Gohmert and other Republicans that sought to empower Vice President Mike Pence to reject Joe Biden’s electoral victory.

A three-judge panel of the Circuit Court of Appeals for the District of Columbia agreed with the lower court that Gohmert, a Texas congressman, and his colleagues lacked standing to file the lawsuit.

The decision leaves Gohmert with the option to appeal to the Supreme Court before Wednesday’s certification in Congress.
