Bernie Kerik's attorney says he has a meeting on 2020 election probe scheduled with Smith next week

"We had scheduled a meeting, and that meeting is still scheduled for next week," Parlatore said.

Former New York City Police Commissioner Bernie Kerik's attorney, Tim Parlatore, said on Wednesday that he plans to have a meeting with Special Counsel Jack Smith next week about the Trump team's investigations of the 2020 elections.

"We had scheduled a meeting, and that meeting is still scheduled for next week," Parlatore told the "Just the News, No Noise" TV show. "And so it was very surprising to me yesterday when he went ahead and did this indictment."

A few days before President Trump was indicted by Special Counsel Jack Smith, Kerik turned over documents to Smith that showed the Trump legal team was still conducting a police-like probe that hadn’t resolved most of the allegations of 2020 election fraud it had collected before the Jan. 6 2021, Capitol riot broke out.

Kerik was running the investigation for Trump’s lead election challenge litigator, former New York City Mayor Rudy Giuliani, according to the memos. 

Trump was charged with four counts on Tuesday, including conspiracy to defraud, conspiracy to obstruct an official proceeding, obstruction of, and attempt to obstruct an official proceeding, and conspiracy against rights.

"The linchpin of this indictment is, 'can they prove knowledge?' Parlatore said. "Because everything rises and falls based on the corrupt intent of whether Donald Trump knew at that time that the claims of fraud were false or not."

"They have interviews scheduled with Mr. Kerik next week, with other witnesses over the next few weeks, that bear directly on that point," he continued. "So why rush to an indictment before you have completed investigating the single most important element of this entire case?"

Parlatore said he called the prosecutors this morning to confirm that the scheduled meeting for next week was still on.
