FEC sued for not charging Biden campaign and DNC over Hunter Biden laptop letter

America First Legal Foundation filed a lawsuit against the Federal Election Commission for not charging President Joe Biden's campaign and the Democratic National Committee for failing to disclose actions connected to the debunked letter from 51 former intelligence officials dismissing reports about Hunter Biden's infamous laptop days before the 2020 election.
America First Legal, a non-profit judicial watchdog, filed a complaint with the FEC in October 2023 alleging that the campaign and the DNC violated U.S. law by failing to report contributions and coordinated communications regarding the letter, but the complaint has been pending for more than 120 days without any action, according to the 143-page lawsuit filed Sunday.
The New York Post broke a story three weeks before the 2020 election showing how Hunter Biden's infamous laptop indicated corruption. Shortly thereafter, current Secretary of State Antony Blinken approached Obama-era CIA Director Michael Morell about drafting a letter that dozens of former intelligence officials signed rebutting the story as Russian disinformation, according to the filing.

"Because Biden campaign resources were used to generate and disseminate the public statement, and because the public statement was disseminated in the media at the request of the Biden campaign, federal law requires public reporting of the costs and beneficiaries of such coordinated communications," according to the watchdog.
America First Legal Vice President Daniel Epstein said that neglecting to disclose coordination to the FEC constitutes election interference.
"It’s not simply a form of dark money, it’s not simply corruption, it’s election interference," he said.
The America First lawsuit demands the FEC investigate the allegations against the Biden campaign and the DNC and impose appropriate sanctions on the parties, among other things.
