Federal prosecutors in court to ask that J6 pipe bomb suspect remain in detention until trial

The Virginia man facing federal charges in connection with the placing of separate pipe bombs at the Democratic and Republican national headquarters in Washington, D.C., on the eve of the Jan. 6, 2021, Capitol Hill riot returns to court Tuesday over whether he should remain detained before his criminal trial.

Justice Department lawyers have argued in court papers that defendant Brian Cole, 30, poses an "intolerable risk" to the community and should continue to be detained, according to CBS News

Cole has yet to enter a plea to the charges.

Prosecutors have also told the court Cole should remain in custody "considering the extreme and profoundly serious nature of his crimes, the overwhelming evidence of his guilt, the years he has spent deceiving those around him to avoid accountability, and the intolerable risk that he will again resort to violence to express his frustration with the world around him."

The Justice Department also said in court filings Sunday that Cole has confessed to constructing the bombs and that when asked about his motive he said, "something just snapped" and that he was upset with both political parties. 

Cole's lawyers have told the court that their client should not be kept in custody while awaiting a trial because he has lived "without incident" for the past four years and has been diagnosed with Autism Spectrum Disorder, Level 1, and obsessive compulsive disorder.  They also said there is "zero evidence" to suggest he would flee ahead of a trial, CBS also reports
