Harvey Weinstein to remain in New York for retrial before serving primary sentence in California
Weinstein has denied all the rape and sexual assault charges brought against him in both states. He is currently being housed at Rikers Island, where he will remain amid the retrial, which has been tentatively scheduled for November.
Former Hollywood movie mogul Harvey Weinstein will remain imprisoned in New York for his rape and sexual assault retrial, but will then go to California to serve a sixteen-year sentence.
Prosecutors confirmed the order of events on Monday after Weinstein made a rare court appearance related to California's efforts to extradite him so he can begin serving time for a separate rape conviction in Los Angeles. He was convicted of rape in California in 2022.
Weinstein was previously convicted of rape in New York in 2020, but the state's highest court threw out the conviction earlier this year, ruling the former producer did not have a fair trial in Manhattan.
“Today, defendant Harvey Weinstein was formally arraigned on a governor’s warrant issued by Governor Kathy Hochul, who exercised her authority for him to remain in New York State until his case in New York County is adjudicated,” Queens District Attorney Melinda Katz said in a statement, per the Associated Press. “He will serve the California sentence first, as it is now his primary sentence.”

Prosecutors in Manhattan said last month that they plan to file new sexual assault charges against Weinstein, but it is not clear when the new charges will be brought.
