A judge on Thursday rejected Peter Navarro's bid to stay out of jail during the appeal of his contempt of Congress conviction for defying a subpoena from the House Jan. 6 Committee.

Navarro, a former adviser in the Trump White House, was sentenced to four months in prison in January, pursuant to a September conviction on two counts of contempt of Congress. Both counts came with a minimum of one month in prison, though prosecutors had sought six months for each charge as well as fines. He was also fined $9,500.

U.S. District Judge Amit Mehta rejected the request, contending that the possibility of success on appeal was not enough on its own to justify keeping Navarro out of prison, Politico reported.

Navarro, Mehta determined, must "report to the designated Bureau of Prisons facility on the date ordered by the BOP."
