The "Star Trek: Discovery" actor filed the suit in 2020, on claims of assault, battery and intentional infliction of emotional distress. The judge dismissed the emotional distress claim as a repetition of the battery claim while tossing out the assault claim as well.
Spacey came out as gay, in part in response to Rapp's initial allegation in 2017. He faces separate sexual assault allegations in the United Kingdom, which he also denies.
