Supreme Court to hear South Carolina's ban on taxpayer funding for abortion providers
Medicaid funds are "intended to help low-income individuals obtain necessary medical assistance," not guarantee Planned Parenthood taxpayer money, state's lawyers say.
The Supreme Court accepted a case Wednesday involving a dispute between South Carolina and Planned Parenthood, limited to the question of whether the "Medicaid Act’s any-qualified-provider provision unambiguously confers a private right upon a Medicaid beneficiary to choose a specific provider."
A federal district judge, twice affirmed by the 4th U.S. Circuit Court of Appeals, ordered the Palmetto State to reinstate Medicaid funding to the abortion provider, prompting Alliance Defending Freedom to petition the high court on behalf of the South Carolina Department of Health and Human Services,
The case "could decide whether pro-life states like South Carolina can direct Medicaid funds—funds intended to help low-income individuals obtain necessary medical assistance—away from abortion providers like Planned Parenthood," ADF said.
