DHS: Manhattan DA's 6-month plea deal for transgender illegal migrant child rapist 'disgraceful'

Manhattan DA Alvin Bragg’s office said the plea deal was reached in close consultation with the victim’s family to spare the teen from.

The Department of Homeland Security says Manhattan District Attorney's Office's six-month plea deal for a transgender illegal immigrant who admitted to raping a 14-year-old is "disgraceful."

"DISGRACEFUL plea deal offered to transgender criminal illegal CHILD RAPIST. The Manhattan District Attorney's Office has offered 'Nicol Alexandra' Contreras-Suarez, a 31-year-old transgender criminal illegal alien from Colombia, an insane SIX-MONTH plea deal in exchange for admitting to following a 14-year-old into the bathroom and RAPING him in February 2025," DHS posted on X on Sunday.

"Contreras-Suarez was let into our country by the Biden administration and then again released from jail following his arrests for armed robbery, assault with a dangerous weapon, and prostitution. This pervert should have NEVER been in our country. Under @POTUS Trump and Secretary Mullin, we will continue to put the safety of Americans first and fight to get criminal illegal aliens like this out of our communities to no longer prey on and victimize innocent children."

Manhattan DA Alvin Bragg’s office said the plea deal was reached in close consultation with the victim’s family to spare the teen from having to testify, and that they expect Contreras-Suarez to be deported after his April 27 sentencing.

DHS said Friday that U.S. Immigration and Customs Enforcement first lodged an immigration detainer with Manhattan Central Booking on Feb. 13, 2025, and that Contreras-Suarez is currently being held at Rikers Island. The New York City Department of Corrections agreed to honor the detainer and not release Contreras-Suarez, the federal agency also said.

U.S. Customs and Border Protection arrested Contreras-Suarez, a biological male, in March 2023 for illegally entering the U.S. in San Ysidro, Calif., according to DHS. 

He was released into the U.S. by the Biden administration and later arrested by Medford Police Department, in Massachusetts, for armed robbery, prostitution and assault with a dangerous weapon. However, Contreras-Suarez was released "due to sanctuary politicians," DHS said.

He pleaded guilty last week to second-degree rape, which usually carries a prison sentence of between two and seven years, the New York Post reported. He received a six-month prison sentence, but will not have to spend additional time behind bars due to time served.
