Missouri AG sues Biden administration over illegal immigrant flights into state

According to the lawsuit, the Biden Administration is "deliberately flying illegal aliens from the border to the interior of the country and has sought to gain public records on behalf of Missouri citizens but has been met with federal interference."

Missouri Attorney General Andrew Bailey filed suit against the Biden Administration on Tuesday for "failing in its legal obligation to fulfill a Freedom of Information Act (FOIA) request asking for documents and communications" related to facilitating the transportation of illegal immigrants into Missouri.

The FOIA was addressed to Department of Homeland Security (DHS), who has not provided the requested information.

The state government of Missouri argued in the lawsuit that the Biden Administration is "deliberately flying illegal aliens from the border to the interior of the country and has sought to gain public records on behalf of Missouri citizens but has been met with federal interference."

Bailey's office said DHS has "responded with a denial of this request based on a clearly erroneous reading of the AGO’s FOIA request."

He argued that "this game of hide and seek’ violates the spirit and the letter of FOIA, which states that an agency shall withhold information only when the agency ‘reasonably foresees that disclosure would harm an interest protected by an exemption’ or if ‘disclosure is prohibited by law.’"
