Border Patrol Chief Raul Ortiz said under oath that President Biden's immigration policies have "no consequences" for illegal immigrants entering the U.S. and are to blame for the historically high number of illegal crossings at the southern border.

Ortiz's comments came during a recorded deposition from July that was part of a lawsuit by Florida Attorney General Ashley Moody against the Department of Homeland Security and other border agencies. Video of the deposition was obtained by Fox News Digital.

"In my experience, we have seen increases when there are no consequences," said Ortiz.

An attorney​ representing Florida then asked Ortiz whether more migrants would likely come to the border because of the lack of consequences.  

"There is an assumption that if migrant populations are told that there is a potential that they may be released, that, yes, you can see increases," he said.

When pressed to clarify his position, Ortiz said illegal immigration increases significantly under such conditions.

The attorney then asked whether "aliens illegally entering the United States perceive that they will be able to enter and remain in the United States" since Biden was elected president.

"Yes," responded Ortiz.
