Republican lawmakers introduce legislation to protect parental rights for education, healthcare

The legislation is titled "The Families’ Rights and Responsibilities Act."

Sens. Tim Scott, R-S.C., and James Lankford, R-Okla., along with Rep. Virginia Foxx, R-Va., introduced legislation to prioritize parental rights.

Those include parental rights in healthcare and education.

"Parents have a fundamental right to control the upbringing of their child, whether it’s in the classroom or at home,” Scott said in an interview with the Daily Signal.

“Yet, far too often, parents are being pushed out of their child’s lives, and kids are paying the price," he added. "I will always fight to put parents back in the driver’s seat and ensure they remain the lead decision-maker in their child’s life.”

The legislation is titled "The Families’ Rights and Responsibilities Act."

The goal of the bill is to stop the federal government from intervening in the fundamental right of parents to raise their kids unless a legal strict scrutiny test is passed. That test is the highest standard of review that a court will use to evaluate the constitutionality of government action.
