Republican Kari Lake taking Arizona voting machine lawsuit to U.S. Supreme Court
“Procedural-rights plaintiffs have standing for a ‘do-over’ under the proper procedures and standards, even if the election might produce the same winners,” argued an attorney for Lake and Mark Finchem, a former Arizona State Representative
U.S. Senate candidate Kari Lake and Mark Finchem, a former Arizona State Representative, want the U.S. Supreme Court to weigh in on their rejected lawsuit, which argues that electronic machines in certain Arizona counties are a violation of constitutional rights.
Attorney Lawrence Joseph announced in a new filing that Lake and Finchem are in possession of evidence that was not previously presented when the lawsuit was originally filed before the 2022 midterm elections.
“Procedural-rights plaintiffs have standing for a ‘do-over’ under the proper procedures and standards, even if the election might produce the same winners,” he wrote. “A court could order ‘do-over’ relief (i.e., counting the paper ballots) in the 2022 election as well as similar relief for future elections.”
An appeals court upheld a judge's August 2022 dismissal of the lawsuit.
