Judge rejects Nevada 14th Amendment challenge to Trump's eligibility
Notably, the Nevada challenge applied to the state primary, but Trump is running in the Republican caucus.
Federal Judge Gloria Navarro on Tuesday dismissed a challenge to former President Donald Trump's eligibility to return to the White House under the 14th Amendment that a Republican presidential candidate brought, without deciding on the merits.
Navarro determined that John Anthony Castro had only filed to run for president to create legal standing as a political competitor to Trump, The Hill reported. The judge highlighted prior comments from Castro in which he admitted that the purpose of his candidacy was to address the matter.
Castro has brought comparable challenges to Trump's eligibility in other key states. Notably, the Nevada challenge applied to the state primary, but Trump is running in the Republican caucus.
The matter of Trump's eligibility will soon reach the Supreme Court, which has agreed to address a Colorado case in which the state Supreme Court determined that Trump's role in the Jan. 6, 2021, Capitol riot, disqualified him under the 14th Amendment's "insurrection" provision.
Oral arguments in that case are scheduled for Feb. 8.
