Supreme Court rules Trump administration must 'facilitate' return of Maryland man wrongly deported
The decision does not mean that the Trump administration must immediately work to facilitate Abrego Garcia's release, but the administration "should be prepared to share what it can concerning the steps it has taken and the prospect of further steps."
The Supreme Court on Thursday unanimously ruled that the Trump administration must "facilitate" the release of the Maryland man who was wrongly deported to an El Salvador prison.
The Trump administration has admitted that it wrongly deported El Salvadoran migrant Kilmar Abrego Garcia back to his homeland, after they suspected he was a member of MS-13. Abrego Garcia was supposed to be protected from deportation by a previous court order.
The decision does not mean that the Trump administration must immediately work to facilitate Abrego Garcia's release, but the administration "should be prepared to share what it can concerning the steps it has taken and the prospect of further steps."
The court also ruled that a lower court judge may have exceeded her authority by saying the government had to not just "facilitate" but also "effectuate" Abrego Garcia's return, and ordered her to "clarify" her order "with due regard to the deference owed to the executive branch in the conduct of foreign affairs," according to NBC News.
The ruling comes after the Supreme Court on Monday sided with President Donald Trump in a 5-4 ruling by lifting a halt on deportation flights for illegal migrants who are suspected of being tied to violent gangs.
