Los Angeles District Attorney Nathan Hochman confirmed Tuesday that former California Democratic Rep. Eric Swalwell is under investigation for alleged sexual misconduct in light of recent allegations made against him.

Swalwell resigned his post earlier Tuesday, which comes the same day a new woman accused him of rape. The woman claimed Swalwell "drugged, choked and raped" her at a California hotel in 2018.

Hochman said he has assigned his department's Sex Crimes Division to work closely with law enforcement partners as part of the investigation, but no charges have been formally brought so far.

“When and if a case is presented, seasoned prosecutors will review the facts and evidence to determine whether there is sufficient evidence for charges to be filed,” he told The Hill. “When a filing decision is made, we will ensure the public is made aware.”

Swalwell's attorney has denied the allegations, claiming the latest case was part of a smear campaign against the former congressman. But the new accuser, Lonna Drewes, said she delayed the case out of fear.

“My delay in taking action against Eric was driven by fear, not doubt,” Drewes said. “Fear of his political power, his background as an attorney and his family law enforcement ties. I have never doubted what happened."
