Trump attorney predicts motion to dismiss charges in Alvin Bragg case
Binnall also indicated that the venue would undermine Trump's ability to receive a fair trial.
One of Donald Trump's attorneys, Jesse Binnall, predicted on Thursday that the former president's legal team would seek to dismiss charges against him in Manhattan District Attorney Alvin Bragg's case.
"I think you're gonna see a motion to dismiss," Binnall said on the "Just the News, No Noise" TV show. "There's a lot of fodder for a motion to dismiss- specifically statute limitations."
A Manhattan grand jury recently voted to indict Trump over his alleged role in a payment to Stormy Daniels in 2016, making him the first former president to face criminal charges. He was arraigned earlier this week and pleaded not guilty to 34 counts of falsifying business records and conspiracy.
Binnall is not on Trump's current trial team, but has worked with the former president on other cases. He has suggested the judge may recuse himself or face a recusal motion over concerns about his ability to be impartial.
"We're gonna have to really see if this is the right judge as well," he continued. "And this judge, I think, needs to take a really hard look to see if he can truly be impartial in this case. And very possibly, I think we can be looking at a recusal motion as well."
Binnall also indicated that the venue would undermine Trump's ability to receive a fair trial.
"There's no chance that Donald Trump's gonna get a fair trial in Manhattan," he stated. "I mean, it's laughable. All the American people on both sides of the aisle know that there's no fair trial available there."
